Roehl challenges the circuit courts determination that there was no dispute of material fact regarding whether Gisselman negligently failed to collaterally challenge a prior OWI conviction while representing Roehl on an OWI-5th charge. For the reasons discussed below, we reverse the summary judgment order, and remand for further proceedings.
